Terms of Use
This is a translation of the Japanese original. If there is any inconsistency between this translation and the Japanese version, the Japanese version prevails.
These Terms of Use (these “Terms”) set out the conditions for using JongBook (the “Application”), a mahjong score sheet app for iOS provided by Ryo Yoshitsugu (the “Provider”). By downloading or using the Application, you are deemed to have agreed to these Terms. Please read these Terms carefully before using the Application.
1. Parties to These Terms
These Terms are an agreement between you and the Provider, and not with Apple Inc. (“Apple”). The Provider, not Apple, is solely responsible for the Application and its content.
2. License
The Provider grants you a non-transferable, non-exclusive right to use the Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service, except that the Application may be accessed and used by other accounts associated with you via Family Sharing or other means as permitted by those Usage Rules.
All copyrights, trademarks, and other intellectual property rights in the Application belong to the Provider or their rightful owners.
3. Prohibited Conduct
When using the Application, you must not:
- Copy, modify, or translate the Application or any part of it, or create derivative works
- Decompile, disassemble, reverse engineer, or otherwise attempt to extract the source code of the Application
- Use paid features without purchasing them by unauthorized means
- Act in violation of laws or public order and morals
4. Paid Service (JongBook Pro)
The Application offers some features as an auto-renewable subscription, “JongBook Pro” (“Pro”). The purchase, billing, renewal, and cancellation of Pro are governed by the following provisions and by the App Store terms set by Apple.
- Pro is available as a monthly plan and a yearly plan. The price of each plan is shown on the purchase screen in the Application, and is charged to the payment method associated with your Apple Account when you confirm the purchase.
- Pro automatically renews for the same period unless auto-renewal is turned off at least 24 hours before the end of the current period. The renewal fee is charged within 24 hours before the end of the current period.
- You can manage and turn off auto-renewal at any time after purchase under Subscriptions for your Apple Account in the Settings app on your iPhone or iPad. Deleting the Application does not cancel your subscription.
- Even if you turn off auto-renewal, you can use Pro until the end of the current period. No prorated refunds are given for cancellation in the middle of a period.
- To request a refund, please apply to Apple in accordance with Apple’s procedures. The Provider cannot issue refunds directly.
- The price and content of Pro plans may change. If the price changes, you will be notified in advance in accordance with App Store procedures.
- You can use Pro on other devices signed in with the same Apple Account by tapping “Restore Purchases” on the purchase screen.
- Even after your Pro period ends, you can continue to view and edit the records you have created. However, you will no longer be able to create new groups or score sheets beyond the limits of the free plan.
- The features provided by Pro and the removal of free plan limits apply only to the user who purchased Pro. Even in a shared group, whether a user can create a score sheet is determined by that user’s own Pro status.
5. Advertising and Usage Analytics
The Application displays ads from Google AdMob. Ads are not displayed while you use Pro. To improve its features, the Application also analyzes how it is used with Firebase Analytics. The handling of information related to these is as set out in the Privacy Policy.
6. Data Storage
Records created in the Application are stored on your device and are not stored on the Provider’s servers. Records in shared groups are also stored in iCloud as set out in Section 7. The Provider cannot back up or restore your records. Records may be lost if the Application is deleted, or if your device breaks down, is lost, is reset, or is replaced. Please protect important records at your own responsibility, for example by backing up your device.
7. Group Sharing via iCloud
The Application provides a feature for sharing a group with other users using Apple’s iCloud (the “Sharing Feature”). To use the Sharing Feature, you must be signed in to iCloud and connected to the internet. In addition to these Terms, the iCloud terms and conditions set by Apple apply to your use of the Sharing Feature.
- Shared group information is stored in the iCloud storage of the user who created the group (the “Owner”). If the Owner’s iCloud storage runs out of space, syncing may stop.
- Anyone who has the invite link can join the group. You are responsible for managing who you send the invite link to.
- Users who join a group can view, create, edit, and delete score sheets in the group. Only the Owner can change the group’s name, members, and default rules.
- The Owner can remove participants from the share and can stop sharing. The group is deleted from the devices of participants who are no longer in the share, but score sheets saved up to that point remain on their devices as score sheets that do not belong to a group.
- Do not enter into a shared group any information that you do not want other participants to know, or any information that infringes the rights of third parties.
- Depending on network conditions and the state of iCloud, it may take time for changes to reach other participants. If multiple participants edit the same item on the same score sheet at the same time, only one of the changes will be applied.
8. Maintenance and Support
The Provider is solely responsible for maintenance and support of the Application. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
9. Warranty
The Provider does not warrant that the Application is fit for a particular purpose, always accurate, operates without interruption, or is compatible with any particular operating system version, except for warranties that cannot be excluded by law.
In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the responsibility of the Provider, not Apple.
10. Disclaimer and Limitation of Liability
Net amounts and other calculation results displayed by the Application are reference information based on what you entered. You shall check and use the calculation results at your own judgment and responsibility.
The Provider is not liable for damages you suffer due to the following, except where they are attributable to the Provider.
- Malfunctions of, or specification changes to, communication lines, devices, or operating systems
- Failures of, specification changes to, or discontinuation of services provided by Apple, Google, or other third parties
- Natural disasters, power outages, war, the enactment, amendment, or repeal of laws, and other force majeure
- Your misoperation of the Application, input errors, or use in violation of these Terms
- Changes to or deletion of records by other participants in a shared group, and participation by others resulting from an invite link reaching unintended recipients
Any dispute arising in connection with the use of the Application between you and other users, players in a game, or other third parties (including disputes over settlements) shall be resolved at your own responsibility, and the Provider will not be involved. Advertisers are responsible for the content of ads displayed in the Application and for products and services offered at destinations reached from those ads.
Even if you suffer damages due to the Provider’s default or tort, where the Provider has not acted with intent or gross negligence (that is, in cases of slight negligence), the Provider’s liability is limited to ordinary and direct damages actually incurred by you, and does not include lost profits, indirect damages, special damages, or damages from the loss of records or other data. In cases of slight negligence, the amount of compensation is capped at the total amount you paid for Pro during the 12 months preceding the month in which the damages occurred.
Some features of the Application require an internet connection. You are responsible for any communication charges.
11. Product Claims
The Provider, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of it, including product liability claims, any claim that the Application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
12. Intellectual Property Infringement
In the event of any third-party claim that the Application or your possession and use of it infringes that third party’s intellectual property rights, the Provider, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
13. Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
14. Third-Party Terms
When using the Application, you must comply with applicable third-party terms of agreement, such as your agreement with your wireless carrier.
15. Third-Party Beneficiary
You and the Provider acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
16. Changes to and Discontinuation of the Application
The Provider may change the content of the Application or provide updates. You may need to download updates to continue using the Application.
The Provider may discontinue the Application. If Pro is to be discontinued, the Provider will give reasonable advance notice on this page or in the Application. Refunds in connection with discontinuation follow Apple’s procedures.
17. Changes to These Terms
The Provider may change these Terms if the change is in the general interest of users, or if the change does not contradict the purpose of these Terms and is reasonable in light of the necessity of the change, the appropriateness of the changed content, and other circumstances relating to the change. In that case, the Provider will announce the changed Terms and their effective date before the effective date, by posting them on this page or by other appropriate means.
18. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Japan. Any dispute relating to these Terms or the Application shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the Provider’s address as the court of first instance.
